Wyomingites Sue USFS Over Fire Damage
In September 2018, a manmade fire in Northwest Wyoming, which started in the Bridger-Teton National Forest, spread southward, causing significant damage. Twenty-three Wyoming residents and organizations have filed a lawsuit against the U.S. Forest Service, seeking monetary compensation for damages to their lands, attorney fees, and other appropriate relief. The plaintiffs argue that the Forest Service negligently allowed the Roosevelt fire to spread unchecked, using it as a means to clear forest debris. The lawsuit alleges both personal and property damage, though specific details of the injuries or damages are not provided. From a legal standpoint, the plaintiffs contend that using an unplanned fire for natural resource benefits violates federal law and contradicts the National Environmental Policy Act. They further accuse the agency of failing to consult with the U.S. Fish and Wildlife Service under the Endangered Species Act. The Federal Tort Claims Act is invoked, asserting the U.S. government's liability for the negligence of its employees.

As experts continue the painstaking task of identifying remains, the specifics of who was in command during the disaster and the reason for the delayed request for state assistance after the town's devastation remain elusive. With county officials avoiding foundational questions and state agencies employing evasive language, determining who was aware of what—and at which point—has proven challenging. However, one stark reality remains: a month later, no official has taken responsibility or publicly apologized for the oversights that may have escalated the death toll.
