This Addendum changes the Wachovia Visa Gift Card Cardholder Agreement (“Agreement”).
This Addendum changes the Wachovia Visa Gift Card Cardholder Agreement (“Agreement”). All terms defined in the Agreement will have the same meaning when used in this Addendum. If there is a conflict between the Addendum and the Agreement, this Addendum will control. Except as expressly amended by this Addendum, the Agreement remains in full force and effect. The section of the Agreement titled “Arbitration,” is deleted and replaced with the following: Arbitration Any controversy or claim between you and us, including, but not limited to, those arising out of or relating to the card, this Agreement, or any related agreement or any claim based on or arising from an alleged tort, shall at the request of either party be determined by arbitration. The arbitration shall be governed by the Federal Arbitration Act (Title 9, U.S. Code), notwithstanding any choice of law provision in this Agreement, and under the authority, and the applicable consumer rules and procedures of, the American Arbitration Association then in effect. Arbitrator(s) must be licensed attorneys with expertise in the substantive laws applicable to the subject matter of the dispute. The arbitration shall take place in the state in which you live. Neither you nor we shall be entitled to join or consolidate disputes by or against others in any arbitration, or to include in any arbitration any dispute as a representative or member of a class, or to act in any arbitration in the interest of the general public or in a private attorney general capacity. We will pay any costs that are required to be paid by us under the arbitration administrator’s rules and procedures, and subject to applicable law.
