A 33-year-old North Carolina dad by the name of Sterling Cummings has been charged with first-degree murder for the death of his 3-month-old son, Waylon. The mom had left the infant with his father while she went out to get groceries and came back to discover her son unresponsive.

Even though CPR was admitted and the child was rushed to the hospital, he did not survive his injuries as this excerpt explains: "He (Cummings) was apparently babysitting while the boy's mother went out to get groceries. When she returned, she says, the baby had not been given the bottle she prepared and he was not breathing. A neighbor performed CPR while she called 911."

Medical reports revealed retinal hemorrhaging and an abnormal MRI as a result of being shaken by Cummings.

According to reports, this was the second time a child has suffered permanent injuries under his watch: "In August 2012, he was living with his girlfriend and their son, Andy, who was about three weeks old. The baby was taken to the hospital after being shaken by Cummings. The incident caused permanent brain damage, leaving the child blind and suffering from cerebral palsy. Andy's mother was also charged, but never prosecuted."

Andy and one of his siblings were adopted by Tracy and Allan Trepcyk who were present at Cummings first court appearance. They said they had tried to warn others that he would repeat what he did to Andy again with another child. Per reports, Cummings was given credit for 20 days in jail and received 60 months of supervised probation for the felony child abuse inflicting serious injury in 2013.

He is now facing first-degree murder and felony child abuse charges for his second child's death.
